The relevance of the social function of property in collective usucapitaião
Abstract
The present research aims to analyze the collective Usucapião institute as an instrument for the acquisition of property by slum dwellers and irregular urban land. It seeks the relationship between the right to property and the principle of the social function of property, also seeks to unravel the modalities of usucapião that we have in our legal system; know the characteristics of the lands that can be used, understand what assumptions are the collective and individual use. To realize a paradigm between the fundamental right to housing, which lacks much state benefits capable of meeting the social demands for decent housing. From this arises, the proposal for land regularization, which would be used as a political and legal instrument, which would be able to regulate housing in informal and irregular situations.
