A eficácia dos instrumentos de pacificação voltados ao efetivo acesso à Justiça

Abstract

The present work aims to demonstrate the importance of access to justice, through the instruments of pacification of conflicts. In 2015, together with the reform of the Code of Civil Procedure, conciliation and mediation were implemented as optional forms of conflict resolution, mainly aiming that jurisdiction is a social instrument of pacification and is struggling to seek harmonization. One cannot ignore the social framework and the reality of the judiciary. Thus, the main objective of the research is to demonstrate the importance of new conflict resolution techniques, based on constructive criticism, where it will be observed that despite the implementation of these instruments in the New Code of Civil Procedure, the judiciary is not being able to take advantage of 100% of its resources, since it is not enough to use the instruments only as a means of reducing the congestion of processes , it is necessary to adopt a new culture, which aims clearly to encourage its adequacy. Moreover, there are many flaws in its use, because despite the existence, often resources are not used, due to lack of structure for proper functioning.
